Introduction

This Privacy Policy outlines Bespoke Digitech's (" we ", " our " or " the Company ") practices with respect to information collected from users who access our website at www.bespokedigitech.com or www.bespokedigitech.co.uk (" Site "), or otherwise share personal information with us (collectively: " Users "). 

Grounds for data collection 

Processing of your personal information (meaning, any information which may potentially allow your identification with reasonable means; hereinafter " Personal Information ") is necessary for the performance of our contractual obligations towards you and providing you with our services, to protect our legitimate interests and for compliance with legal and financial regulatory obligations to which we are subject.

When you use the Site, you consent to the collection, storage, use, disclosure and other uses of your Personal Information as described in this Privacy Policy.

We encourage our Users to carefully read the Privacy Policy and use it to make informed decisions. 

What information we collect?

We collect two types of data and information from Users. 

The first type of information is un-identified and non-identifiable information pertaining to a User(s), which may be made available or gathered via your use of the Site (“ Non-personal Information ”). We are not aware of the identity of a User from which the Non-personal Information was collected. Non-personal Information which is being collected may include your aggregated usage information and technical information transmitted by your device, including certain software and hardware information (e.g. the type of browser and operating system your device uses, language preference, access time, etc.) in order to enhance the functionality of our Site. We may also collect information on your activity on the Site (e.g. pages viewed, online browsing, clicks, actions, etc.).

The second type of information Personal Information which is individually identifiable information, namely information that identifies an individual or may with reasonable effort identify an individual. Such information includes:
  • Device Information: We collect Personal Information from your device. Such information includes geolocation data, IP address, unique identifiers (e.g. MAC address and UUID) and other information which relates to your activity through the Site.
  • Personal Information: We collect Your Name, Phone Number and Email Address to contact you with quotes, offers and new announcements. 
  • Registration information: When you register to our Site you will be asked to provide us certain details such as: full name; e-mail or physical address, and other information.   

How do we receive information about you?

We receive your Personal Information from various sources:
  • When you voluntarily provide us your personal details in order to register on our Site;
  • When you use or access our Site in connection with your use of our services;
  • From third party providers, services and public registers (for example, traffic analytics vendors).

What information we collect?

We do not rent, sell, or share Users’ information with third parties except as described in this Privacy Policy.

We may use the information for the following
  • Communicating with you – sending you notices regarding our services, providing you with technical information and responding to any customer service issue you may have;

User Rights

You may request to: 
  1. Receive confirmation as to whether or not personal information concerning you is being processed, and access your stored personal information, together with supplementary information. 
  2. Receive a copy of personal information you directly volunteer to us in a structured, commonly used and machine-readable format. 
  3. Request rectification of your personal information that is in our control.
  4. Request erasure of your personal information. 
  5. Object to the processing of personal information by us. 
  6. Request to restrict processing of your personal information by us.
  7. Lodge a complaint with a supervisory authority.

Retention

We will retain your personal information for as long as necessary to provide our services, and as necessary to comply with our legal obligations, resolve disputes, and enforce our policies. Retention periods will be determined taking into account the type of information that is collected and the purpose for which it is collected, bearing in mind the requirements applicable to the situation and the need to destroy outdated, unused information at the earliest reasonable time. Under applicable regulations, we will keep records containing client personal data, account opening documents, communications and anything else as required by applicable laws and regulations. 

We may rectify, replenish or remove incomplete or inaccurate information, at any time and at our own discretion.

Cookies

We and our trusted partners use cookies and other technologies in our related services, including when you visit our Site or access our services. 

A "cookie" is a small piece of information that a website assign to your device while you are viewing a website. Cookies are very helpful and can be used for various different purposes. We also use a tool called “Google Analytics” to collect information about your use of the Site. Google Analytics collects information such as how often users access the Site, what pages they visit when they do so, etc. We use the information we get from Google Analytics only to improve our Site and services. Google Analytics collects the IP address assigned to you on the date you visit sites, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Google’s ability to use and share information collected by Google Analytics about your visits to this Site is restricted by the Google Analytics Terms of Use and the Google Privacy Policy.

Third party collection of information

Our policy only addresses the use and disclosure of information we collect from you. To the extent you disclose your information to other parties or sites throughout the internet, different rules may apply to their use or disclosure of the information you disclose to them. Accordingly, we encourage you to read the terms and conditions and privacy policy of each third party that you choose to disclose information to. 

This Privacy Policy does not apply to the practices of companies that we do not own or control, or to individuals whom we do not employ or manage, including any of the third parties which we may disclose information as set forth in this Privacy Policy. 

How do we safeguard your information?

We take great care in implementing and maintaining the security of the Site and your information. We employ industry standard procedures and policies to ensure the safety of the information we collect and retain, and prevent unauthorized use of any such information, and we require any third party to comply with similar security requirements, in accordance with this Privacy Policy] . Although we take reasonable steps to safeguard information, we cannot be responsible for the acts of those who gain unauthorized access or abuse our Site, and we make no warranty, express, implied or otherwise, that we will prevent such access.

Transfer of data outside the EEA 

Please note that some data recipients may be located outside the EEA. In such cases we will transfer your data only to such countries as approved by the European Commission as providing adequate level of data protection, or enter into legal agreements ensuring an adequate level of data protection.

Advertisements

  We may use a third-party advertising technology to serve advertisements when you access the Site. This technology uses your information with regards to your use of the Services to serve advertisements to you (e.g., by placing third-party cookies on your web browser).

Marketing

We may use your Personal Information, such as your name, email address, telephone number, etc. ourselves or by using our third party subcontractors for the purpose of providing you with promotional materials, concerning our services, which we believe may interest you.  

Out of respect to your right to privacy we provide you within such marketing materials with means to decline receiving further marketing offers from us. If you unsubscribe we will remove your email address or telephone number from our marketing distribution lists. 

Please note that even if you have unsubscribed from receiving marketing emails from us, we may send you other types of important e-mail communications without offering you the opportunity to opt out of receiving them. These may include customer service announcements or administrative notices.

Corporate transaction

We may share information in the event of a corporate transaction (e.g. sale of a substantial part of our business, merger, consolidation or asset sale). In the event of the above, the transferee or acquiring company will assume the rights and obligations as described in this Privacy Policy.

Minors

We understand the importance of protecting children’s privacy, especially in an online environment. The Site is not designed for or directed at children. Under no circumstances shall we allow use of our services by minors without prior consent or authorization by a parent or legal guardian. We do not knowingly collect Personal Information from minors. Updates or amendments to this Privacy Policy

We reserve the right to periodically amend or revise the Privacy Policy; material changes will be effective immediately upon the display of the revised Privacy policy. The last revision will be reflected in the "Last modified" section. Your continued use of the Platform, following the notification of such amendments on our website, constitutes your acknowledgment and consent of such amendments to the Privacy Policy and your agreement to be bound by the terms of such amendments.

Terms & Conditions for Websites

We don’t want to get too legal with Terms and Conditions; we like to keep it simple. But, we need to make sure that You and Bespoke Digitech are both in agreement to some simple things. Bespoke Digitech will provide you a Proposal for the cost of designing, managing and hosting a website for You. Your approval of the Proposal via return email will activate the following terms and conditions.



Bespoke Digitech is the trading name for website and App design and development services provided by Ankita Gupta. These Terms and Conditions (“Terms”) are agreed by Bespoke Digitech and the entity agreeing to these Terms (“You”). We are licensed partners of the Eazi Business group and use their licensed CMS to create websites for our clients.



 

Agreement

 

When You purchase a website design (the “Website”) from Bespoke Digitech, You agree to supply all the text and images/photos to be used in the build of Your Website (“Content”).

 

Bespoke Digitech may offer images from its library or images sourced online. You will be advised of the cost of any images that are required to be purchased by us on your behalf. Upon Your approval, this cost will be in addition to the agreed site build cost.

 

Bespoke Digitech agrees to design the number of pages as specified within the Proposal and will only proceed with a mock-up design once all the Content has been provided.

 

Images and Videos should be properly labelled and of best quality possible. Videos should only be in YouTube or Vimeo format. No other formats will be accepted.

 

Bespoke Digitech will build the Dynamic Content Website with an initial dynamic content front page mock-up for desktop, tablet and mobile, and present that to You for approval before the site moves to a full build. 

 

The mock-up is of a design concept nature and contains minimal content. This mock-up will be charged at a rate of a front-page build, and is payable regardless of moving to a full build site or not. If a full build site is ordered, the mock-up cost becomes part of the full build cost.

 

Upon approval of this mock-up, Bespoke Digitech will invoice You for 50% of the site build cost based on the proposal you have agreed to. When the payment has been confirmed as paid, Bespoke Digitech will then move to a full build of the Dynamic Content Website which will be finalized within 7-21 working days. Bespoke Digitech will allow You to make one set of back and forth (edits) to this site based on the information You have provided us via the site build form and prior emails. Any edits that are a result of a mistake by Bespoke Digitech is not included in the single back and forth emails.

 

Bespoke Digitech will only provide access to the Dynamic Content Site after it has been made live. Any changes made by You that result in site damages, malfunction, will not be the responsibility of Bespoke Digitech. Bespoke Digitech will be able to repair the damage at an additional cost.

 

Access to the Content Management System, Site Management and Hosting Services are to be paid by direct debit payments or recurring credit card payments (or any other payment method that has been agreed).

Any externally linked subdomains/ domains, which are to be used in conjunction with the main website, will be hosted externally and may not be hosted on AWS ( Amazon Web Services). The websites built on the Eazi-Sites CMS are hosted on AWS. We do not take any guarantee for the hosting provider of such sub domains/ websites built on other CMS’s such as wordpress/ shopify/ weebly etc. which are linked to the main website built on the Eazi Sites dashboard.

 

Bespoke Digitech makes no guarantees that any of its products or services will increase Your business, result in page one google ranking, increase revenues, or cure Global Warming, the Common Cold or create World Peace. 

 

Bespoke Digitech reserve the right to decline projects that have content that is discriminatory, violent or is sexually explicit in nature.

 

You take full responsibility for all material supplied in connection with Your Website.

 

All Intellectual Property Rights (including, without limitation, all database rights, rights in designs, rights in know-how, patents and rights in inventions (in all cases whether registered or unregistered and including all rights to apply for registration) and all other intellectual or industrial property rights in any jurisdiction) in any information, content, materials, data or processes contained in or to this website belong to Bespoke Digitech. All rights of Bespoke Digitech in such Intellectual Property Rights are hereby reserved.

 

Bespoke Digitech holds no responsibility for the failure of any external links or third party application that have been integrated into the website.



 

Price and Payment

 

Payment is to be made on a month to month basis, a month in advance and for a minimum term as agreed within the Proposal. Under no circumstances shall You be entitled to make any deduction or withhold payment for any reason.



 

All Graphic works created by Bespoke Digitech will be watermarked and remain the property of Bespoke Digitech until all outstanding invoices have been paid. 

 

Failure of payment will result in You having 14 days to rectify the payment situation of which You will be notified. If the situation is not rectified within 14 days, Bespoke Digitech reserve the right to suspend Your site and/or services from public view. If the situation is not rectified within an additional 14 days, Bespoke Digitech reserve the right to terminate the site and/or service.

 

You agree to pay an administration charge of £125 (plus VAT if applicable) to restore the Website in the event of its suspension for non-payment.

 

Any additions/changes to the site that have not been provided in the initial information and changes that are not associated to the original information will be completed at an additional cost. You will be advised of any additional cost in advance and given the option to accept or reject these changes.

 

Bespoke Digitech defines an edit as a change that requires no redesign of graphics, layout or additional pages. A change or addition is defined as any action that requires a new graphic design, change of template or layout, or additional pages.



 



 

Cancellation



 

We may cancel this agreement at any time without giving any reason. For the purposes of the following clauses, the “Notice Date” and “Cancellation Date” shall then be the date on which We give notice of Our cancellation. Should We cancel this agreement prior to the completion of the design of the Website We will refund to You the amount paid for the design and any Licence payments. Should We cancel this agreement following the completion of the design of the Website We will refund to You any Licence payment made after the most recent Licence Renewal Date.



 

Disclaimers of all warranties

 

Bespoke Digitech content, the site and the services are provided on an "as is" and "as available" basis. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

 

Without limiting the above, (i) we make no warranty that the site, the services or the content will meet Your requirements, or will be uninterrupted, continuous, timely, secure, accurate, correct, complete or available; (ii) we do not endorse or approve any content provided by any party other than us and disclaim all liability whatsoever thereto; and (iii) we do not warrant or make any representations regarding the use or the results of this site, the services or the content in terms of its correctness, completeness, results, availability, accuracy, reliability or otherwise.

 



 

Limitation of Liability

 

To the fullest extent permitted by law, under no circumstances shall we be liable for any injury, death, act of god, accident, delay, direct or indirect, incidental, punitive, special, exemplary or consequential damages arising out of any (i) use or the inability (for any reason) to use any part of this site or the services (including without limitation inaccuracies or errors of information as a result of accessing this site or the services), (ii) action or inaction in connection with this agreement or for cost of procurement of substitute services, or (iii) statements or conduct of You or any third party on this site or Your, including without limitation any submissions thereon; in each case, including but not limited to, damages for loss of profits, even if we have been advised of the possibility of such damages, whether based on contract, tort, negligence, strict liability or otherwise.

 

All of the above limitations shall apply notwithstanding any failure of essential purpose of any limited remedy and are fundamental elements of the bargain between Us and You. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or in connection with the Site, the Services, the Content or the Agreement must be filed within thirty (30) days after such claim or cause of action arose or be forever barred.

 

In the event this limitation of liability shall be for any reason held unenforceable or inapplicable, You agree that Our aggregate liability shall not exceed amount paid by You to Us pursuant to this Agreement.



 

Indemnification

 

You release, and agree, at Your own expense, to indemnify, defend and hold harmless us, our officers, directors, employees, licensees, agents and affiliates, from all claims, liabilities, loss and damages (of every kind, whether known or unknown and suspected or unsuspected) related to in any way to: (i) Your use of, access to or reliance on this site, the services or the content, or (ii) Your violation of any of the terms of this agreement or any applicable laws or regulations.

 

We will provide You with written notice of such claim. You will not enter into any settlement or compromise of any such claim without Our prior written consent. We may assume the exclusive defence and control of any matter subject to indemnification by You. In all events, You shall cooperate fully in the defence of any claim.



 

Changes to Terms and Conditions

 

All terms and conditions above are subject to change without prior notice and shall take effect immediately. If You do not accept a Change, You must cancel Your website. If You do not object to a Change by cancelling Your website within the one calendar month notice period, You will be deemed to have accepted the Change.



 

Governing Law

 

This Agreement is governed by the law of England and Wales, and is subject to the exclusive jurisdiction of the courts of England and Wales.
